Intercept End User License Agreement.

This End User License Agreement ("EULA") is a legal agreement between you and KB1SLN Labs LLC ("KB1SLN Labs," "we," "us," or "our") governing your use of Intercept, including its desktop application, updates, installers, documentation, licensing services, and protected-download services (collectively, the "Software").

By downloading, installing, accessing, or using the Software, you agree to this EULA. If you do not agree, do not download, install, access, or use the Software.

1. License; not a sale

Subject to your compliance with this EULA and your valid license entitlement, KB1SLN Labs grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on supported devices for lawful flight-simulation use.

The Software is licensed, not sold. KB1SLN Labs and its licensors retain all rights, title, and interest in and to the Software that are not expressly granted to you by this EULA.

2. Eligibility and supported use

You may use the Software only if you can enter into a binding agreement under applicable law.

Intercept is a flight-simulation companion application. Current releases may support only the operating systems, simulator versions, aircraft add-ons, and configurations identified by KB1SLN Labs.

We do not guarantee compatibility with every computer, operating system, simulator version, aircraft add-on, navigation-data source, scenery package, hardware device, or third-party service. We may change supported configurations, features, or availability over time.

3. Simulation only; no real-world aviation use

The Software is intended solely for entertainment, simulation, and practice.

It is not certified for, and must not be used for, real-world aircraft operation, navigation, dispatch, air traffic control, emergency response, safety-critical activity, or flight instruction requiring regulatory approval.

You are responsible for your simulator environment, aircraft add-ons, system configuration, and all decisions you make while using the Software.

4. Activation, device limits, and access

The Software may require a license key, device activation, periodic license refresh, or Internet access to verify entitlement and receive protected downloads or updates.

Your license is personal to you. You may use it only on the number of active devices allowed by your license entitlement. You may not share, sell, publish, transfer, or make available your license key, activation token, protected download link, or other access credential.

If a device is replaced or no longer available, use the deactivation feature when available or contact support for reasonable assistance.

We may suspend or block an activation where reasonably necessary to enforce this EULA, investigate fraud or misuse, protect the Software or its users, address a security issue, or comply with law.

5. Alpha, preview, and pre-release software

If the Software is labeled alpha, preview, beta, evaluation, or pre-release:

• It may be incomplete, unstable, contain defects, change without notice, or be discontinued.
• Access may expire on the date stated in your acceptance, purchase, or access notice.
• Support is best-effort; we do not guarantee a response time or resolution.
• You must not redistribute the build, installer, license key, activation token, or download link without our written permission.
• We may suspend, expire, or withdraw pre-release access at any time.

Pre-release access is not a promise that any feature, version, or commercial release will be made available.

6. Updates and protected downloads

The Software may check for available updates and may request authenticated, time-limited download links for updates you are entitled to receive.

Updates are part of the Software and are governed by this EULA unless separate terms accompany them. We may require updates where reasonably necessary for security, compatibility, licensing, or continued operation.

We do not promise that all updates, old versions, or services will remain available indefinitely.

If we discontinue the activation service, we will provide at least 90 days' notice where practical and will make reasonable efforts to provide an offline activation or unlock method so purchased licenses remain usable.

7. Restrictions

Except to the extent applicable law expressly permits otherwise, you may not:

• Copy, modify, distribute, sell, lease, rent, lend, sublicense, or commercially exploit the Software.
• Reverse engineer, decompile, disassemble, or attempt to derive the Software's source code or underlying structure.
• Bypass, disable, tamper with, or circumvent any licensing, activation, verification, encryption, update, download, or access-control mechanism.
• Use or distribute tools, patches, or methods intended to defeat those protections.
• Remove copyright, trademark, or other proprietary notices.
• Use the Software in violation of law or in a way that interferes with its security, operation, or other users.

8. Third-party products and services

The Software may interoperate with third-party simulators, aircraft add-ons, navigation data, operating systems, online services, and hardware.

Those products and services are governed by their own terms and privacy policies. KB1SLN Labs does not control and does not guarantee the availability, accuracy, compatibility, security, or continued operation of third-party products or services.

You are responsible for obtaining any required third-party licenses and permissions.

Purchases and refunds. Purchases made on interceptapproach.com are sold through Link, Stripe's checkout service, with Stripe acting as the merchant of record; your receipt will show the purchase as "Sold through Link". KB1SLN Labs LLC is the developer and licensor of the Software and the party that issues your license. Applicable sales tax is added at checkout. If Intercept is not working out for you, email support@kb1slnlabs.com within 14 days of purchase and we will refund the full price to your original payment method; you may also request a refund through Link support. Refunded licenses are deactivated. Purchases made through a third-party store remain governed by that store's refund policy.

Open-source components. The Software includes open-source components licensed under their own terms. A list of these components and their licenses is included with the Software (THIRD-PARTY-NOTICES) and available at interceptapproach.com/third-party-notices.

9. Privacy and diagnostics

Our handling of personal information is described in the Intercept Privacy Notice at interceptapproach.com/privacy. For details on legal basis, retention, and your privacy rights, see that Privacy Notice.

To activate and maintain a license, the Software may send information such as a cryptographic device identifier, license and activation identifiers, license token, Software version, operating-system platform, and release channel to our licensing service.

The Software may create diagnostic logs locally on your device. We may ask you to voluntarily send logs, screenshots, configuration details, or feedback to help investigate a support issue. Do not send passwords, license keys, access tokens, payment information, or unrelated sensitive personal information through support channels.

10. Feedback

If you provide feedback, suggestions, defect reports, screenshots, logs, or other material about the Software, you grant KB1SLN Labs a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, publish, and incorporate that feedback into the Software and related services without compensation or attribution.

Do not submit material you do not have the right to share.

11. Ownership and intellectual property

The Software, including its code, design, documentation, names, logos, and related materials, is owned by KB1SLN Labs or its licensors and is protected by intellectual-property laws.

"Intercept" and "KB1SLN Labs" are names and marks of KB1SLN Labs. This EULA grants no ownership, trademark, patent, or other intellectual-property rights except the limited license stated above.

12. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, COMPATIBILITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.

WE DO NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR WORK WITH EVERY SIMULATOR, AIRCRAFT, DEVICE, CONFIGURATION, OR THIRD-PARTY SERVICE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KB1SLN LABS AND ITS LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR DAMAGE ARISING FROM SIMULATOR CONFIGURATION OR THIRD-PARTY PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KB1SLN LABS' TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS EULA WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KB1SLN LABS FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50).

Nothing in this EULA excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for statutory consumer guarantees that cannot lawfully be excluded (including under the UK Consumer Rights Act 2015, European Union consumer law, and the Australian Consumer Law).

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these limits apply only to the extent permitted by law.

14. Indemnity

To the maximum extent permitted by law, you will indemnify and hold harmless KB1SLN Labs and its licensors from claims, liabilities, damages, and expenses arising from your unlawful use of the Software or your material breach of this EULA.

15. Termination

This EULA remains in effect until terminated.

It terminates automatically if you materially breach it. We may suspend or terminate access where reasonably necessary to enforce this EULA, protect the Software, address security or legal concerns, or end a pre-release program.

On termination, you must stop using and delete all copies of the Software in your control. Sections that should reasonably survive termination will survive, including ownership, feedback, disclaimers, limitations of liability, indemnity, and governing-law provisions.

16. Governing law and disputes

This EULA is governed by the laws of the State of Connecticut, United States of America, excluding its conflict-of-laws rules.

Any dispute arising from this EULA or the Software must be brought in a state or federal court located in Connecticut, United States, unless applicable law requires otherwise.

Nothing in this EULA limits consumer protections that cannot legally be waived in the country, state, or province where you live.

17. Export compliance

You may not use, export, or re-export the Software in violation of applicable export-control, sanctions, or trade laws.

18. Changes to this EULA

We may update this EULA from time to time. The current version will be posted at interceptapproach.com/eula with its effective date.

Changes apply to new purchases and, going forward, to our services (activation, updates, downloads, and support). They do not retroactively reduce the license rights already granted to you for a version of the Software you have already licensed. If you do not accept a material change to the service terms, you may continue using the version of the Software already installed on your device, subject to Section 6 (Updates).

If a change is material, we will provide notice where required by law. Your continued use of our services after the updated EULA becomes effective means that you accept it.

19. General terms

If any provision of this EULA is found unenforceable, the remaining provisions remain in effect.

This EULA, together with the Privacy Notice and any license or purchase terms expressly provided with the Software, is the entire agreement between you and KB1SLN Labs regarding the Software.

Our failure to enforce a provision is not a waiver of our right to enforce it later.
